Clients that passed away in the year 2020 can receive the recover rebate credit.

If the deceased individual was alive on 1/1/2020, they qualify for the first and second stimulus checks if they meet the income thresholds. You can file a tax return to claim the $1,200 and $600 stimulus checks on their family’s behalf. Originally, if the client had passed away before receiving the check, the IRS was requesting that the check be returned. This was reversed in the second stimulus check filing, and clarified that those that passed away on 12/31/2019 or prior do not qualify for the recovery rebate credit.

Our Recommendations

  • If their family had returned the first $1,200 stimulus check to the IRS, but they were still alive as of 1/1/2020, then you can file the recovery rebate credit for the first check.
  • If their family had not received the second $600 stimulus check, then they can claim that portion of the recovery rebate credit on their 2020 tax return.
